The Court of appeal has dismissed the motion brought by the embattled suspended Chief Justice Of Nigeria, ( CJN ), Walter Onnoghen seeking for a stay of action in his trial at the Code of Conduct Tribunal, CCT.
The ruling was delivered by a three-man panel, led by Justice Abdul Aboki.
The court said, in view of the provision of Section 306 of the Administration of Criminal Justice Act (ACJA), it lacked the power to stay proceedings in criminal cases.
By the ruling, the CCT is now free to resume proceedings in the charge before it.
The federal government is prosecuting him for alleged false assets declaration.
